The key factor here is in drafting and negotiating the terms of contract, the lawyer in charge should always consider the prevailing regulatory scheme and applicable laws for effective compliance and mitigating any unintended harms.

In Turkey, with a few exceptions, contracts do not need to be formally and in writing to be valid. However, in case of any legal dispute, it would immensely help to execute the contracts in writing in order to prove any claims arising out of implementation of the contracts, as such minimize any associated risks.
